TERM OF SERVICE
These are the terms and conditions on which Fitbaltics supplies products to you. Please read them carefully before placing an order. By ordering from us, you agree to be bound by these terms. We may update these terms at any time by posting a revised version on our website; the version in force at the time you place your order will govern that purchase.
1. Who We Are and How to Contact Us
1.1 Who we are. We are Fitbaltics, an online fitness and sports retail store. Our business address is Brivibas gat. 372, Vidzemes priekspilseta, Riga, LV-1006, Latvia.
1.2 How to contact us. You can reach us by email at hello@fitbaltics.com. We aim to respond to all enquiries within 2 business days.
1.3 How we may contact you. If we need to contact you, we will use the email address you provided when placing your most recent order.
2. Placing an Order
2.1 How to place an order. Orders are placed through our website. Add the products you would like to your basket and proceed through our checkout, where you will be asked to provide your contact, delivery, and billing details. Please review your order carefully, including product(s), size(s), and delivery address, before completing your purchase.
2.2 Acceptance of your order. Your order is an offer to purchase the products in your basket. You will receive an order confirmation email when we receive it. Our formal acceptance takes place when we email you to confirm dispatch. A binding contract is formed at that point. Please quote your order number in any correspondence with us.
2.3 Eligibility. To place an order you must be at least 18 years old and authorised to use the payment method you provide. If you are under 18, you may only order with the involvement of a parent or legal guardian.
3. Our Right to Cancel Your Order
3.1 Unable to fulfil your order. If we are unable to fulfil your order, for example because a product is out of stock, we cannot verify your billing information, you have requested delivery to a country we do not ship to, or there is a pricing or description error, we will notify you by email and you will not be charged.
3.2 Unusual or suspicious activity. Our products are sold for personal use only. We may cancel an order if we have reasonable grounds to believe products are being purchased for commercial, business, or resale purposes. If you believe we have made an error, please contact us at hello@fitbaltics.com.
3.3 Suspension of supply. We may temporarily suspend supply of a product to: (a) deal with technical problems or make minor technical changes; (b) update the product to reflect changes in applicable law; or (c) make other changes as notified to you.
4. Our Products
4.1 What we sell. We provide fitness gear, including clothing and accessories.
4.2 Product descriptions. Images on our website are for illustrative purposes only. While we work to display colours accurately, we cannot guarantee that your screen exactly reproduces the colours of our products. Descriptions are provided in good faith and minor variations may occur.
4.3 Sizing. Please refer to our size guide on the website before ordering. Sizing can vary between products. We recommend checking measurements rather than relying solely on your usual size.
5. Delivery
5.1 Delivery destinations. We ship to Latvia and other selected countries as displayed during checkout. Available destinations may change from time to time.
5.2 Risk and title. The risk of loss passes to you upon our delivery of the products to the carrier. Title transfers to you upon our receipt of full payment.
5.3 Delivery costs. Delivery charges are shown at checkout before you complete your order. Free delivery thresholds and promotions, if applicable, are displayed on our website.
5.4 Delivery times. Estimated delivery times are shown at checkout and depend on your location and chosen delivery method. During promotional or sale periods, processing and delivery may take longer.
5.5 Delays outside our control. If delivery is delayed by circumstances outside our control, such as postal or courier delays, customs issues, or severe weather, we will notify you as soon as possible. If the delay is likely to be substantial, you may cancel your order and receive a full refund for products paid for but not received.
5.6 Failed delivery. If no one is available to accept delivery and the products cannot be left securely, the courier will notify you and advise how to rearrange delivery or collection. We are not responsible for additional charges arising from failed delivery where you provided an incorrect address or were unavailable.
5.7 Customs and import duties. For deliveries outside the European Union, additional customs duties, taxes, or import charges may apply. These costs are not included in our prices and are your responsibility.
6. Your Rights and Returns
6.1 Faulty or misdescribed products. If a product is faulty or materially different from how it was described on our website, you may be entitled to a repair, replacement, or refund under applicable consumer protection law. Please contact us at hello@fitbaltics.com within a reasonable time of discovering the defect.
6.2 Right to cancel (EU/EEA customers). If you are based in the EU or EEA, you have the right to cancel your order within 14 days of receiving the products, without giving any reason, under the EU Consumer Rights Directive. To exercise this right, notify us before the 14-day period expires by emailing hello@fitbaltics.com. You must return the products within 14 days of notifying us. The direct cost of return is your responsibility unless we agree otherwise.
6.3 Goodwill returns. We also offer a 30-day goodwill returns window from the date you receive your order. You may return products within this period if you have changed your mind, provided they are unused, unworn, unwashed, and in their original packaging with all tags and labels intact. Return shipping costs are your responsibility.
6.4 Products that cannot be returned. The following cannot be returned for hygiene, safety, or other reasons: (a) underwear, swimwear, water bottles, and shakers; (b) products sealed for health or hygiene purposes that have been unsealed after delivery; (c) custom-made or personalised items; (d) items from which the care label has been cut or removed; (e) items missing component parts on return, unless we are at fault; (f) items mixed inseparably with other goods; (g) items marked as final sale.
6.5 Condition of returned items. Products must be returned in the same condition as received. We reserve the right to refuse a return or reduce the refund if products show signs of use, damage, or missing packaging beyond what was necessary to inspect them.
6.6 How to initiate a return. Contact us at hello@fitbaltics.com with your name, order number, delivery address, and reason for the return. We will provide further instructions.
7. Refunds
7.1 How refunds are processed. We will refund the price you paid for returned products, including standard delivery costs where applicable, using the same payment method as your original purchase. Refunds are processed as soon as reasonably practicable and no later than 14 days after we receive the returned products.
7.2 Discount codes and part-payment. If you used a discount code, the refund will reflect the discounted price actually paid. If your purchase was made partly by gift card and partly by another method, the refund is applied to the gift card balance first.
7.3 Exchanges. We do not offer direct exchanges. Please return your original item and place a new order for the alternative product or size.
8. Price and Payment
8.1 Prices. All prices are displayed on our website in the applicable currency. Prices include VAT where required under Latvian and EU law. Delivery costs are shown separately at checkout.
8.2 Price changes. We may update product prices at any time. The price applicable to your order is the price shown when you place your order.
8.3 Pricing errors. Despite our best efforts, products may occasionally be mispriced. If we discover an error before dispatch, we will notify you and give you the option to proceed at the correct price or cancel for a full refund. If the error was obvious and could reasonably have been recognised as a mispricing, we may cancel the order.
8.4 Payment methods. We accept payment by major credit and debit cards (Visa, Mastercard) and other methods displayed at checkout. Payment is taken when your order is dispatched.
8.5 Instalment and deferred payment options. We may offer instalment or deferred payment options through third-party providers. These are subject to the relevant provider’s approval and their terms and conditions. We reserve the right to withdraw these options at any time.
9. Discount Codes
9.1 We may issue discount codes (Codes) through email or other marketing channels. Codes entitle you to a discount on an eligible order when entered correctly at checkout.
9.2 The following conditions apply to all Codes unless otherwise stated: (a) Codes are valid only for the time period specified. (b) Codes apply only to full-priced items and cannot be used on sale, promotional, or outlet items, or to purchase gift cards. (c) Only one Code may be used per order and cannot be combined with any other offer. (d) Codes cannot be applied to delivery charges and are non-transferable. (e) Returned items purchased with a Code will be refunded at the discounted price paid. (f) We reserve the right to cancel orders where a Code is used invalidly or fraudulently, and to withdraw or amend Codes at any time.
10. Gift Cards
10.1 Gift cards are available on our website and are issued as digital codes. You may also purchase a gift card as a gift for someone else.
10.2 Gift cards have no expiry date and are not subject to any inactivity fees or charges.
10.3 Gift cards cannot be purchased using another gift card as payment.
10.4 Gift cards can only be redeemed at fitbaltics.com. They cannot be redeemed on any other platform and cannot be exchanged for cash.
10.5 If you return an order paid partly or fully by gift card, the refund is applied to the gift card balance first, with any remaining amount refunded to your original payment method.
10.6 If an order containing a gift card is cancelled or refunded, the gift card may be disabled or dismissed in accordance with our system settings at the time.
10.7 We are not responsible for lost, stolen, or unauthorised use of gift card codes. Please keep your code secure and do not share it.
11. Reward Points Programme
11.1 We operate a Reward Points programme that allows registered customers to earn points on qualifying purchases and redeem those points for discounts on future orders.
11.2 Earning points. Points are awarded automatically on qualifying purchases based on the product value (excluding delivery costs and taxes, unless stated otherwise). Points are credited to your account once the order reaches the qualifying status. Sale and promotional products may be excluded from points earning. If you use a discount code on an order, points may be calculated on the order value after the discount is applied.
11.3 Extra points. You may earn additional points by: (a) registering an account; (b) logging in daily for the first time that day; (c) completing your profile; (d) signing up through a referral link; (e) referring a customer who makes a purchase; (f) leaving a verified product review; (g) placing a certain number of orders; (h) achieving a loyalty level; or (i) on your birthday. Specific point values for each action are displayed in your account.
11.4 Loyalty levels. Our programme includes the following levels based on total points collected: Starter (0 to 499 points), Athlete (500 to 1,499 points), Beast Mode (1,500 to 2,999 points), and Champion (3,000 points and above). Your level badge is visible in your account and may unlock additional benefits.
11.5 Redeeming points. Points may be redeemed at checkout as a discount on qualifying orders, subject to the minimum redemption threshold shown on our website. Points cannot be exchanged for cash.
11.6 Points and cancellations or refunds. If an order is cancelled, any points earned from that order will be removed. If an order is refunded, earned points may be removed and previously redeemed points may be reinstated, in accordance with our system settings at the time.
11.7 Expiry. Points may expire after a period of inactivity as specified in our programme rules, displayed in your account. We will endeavour to notify you before points expire.
11.8 Programme changes. We may amend, suspend, or terminate the Reward Points programme at any time with reasonable advance notice where possible.
11.9 Misuse. Points obtained through fraud, system abuse, or error may be removed without notice. We may suspend or close accounts involved in misuse.
12. Our Liability to You
12.1 We are responsible for foreseeable loss or damage caused by our failure to comply with these terms or to use reasonable care and skill.
12.2 We are not responsible for unforeseeable, indirect, consequential, or incidental loss, including lost profits or lost data, even if we were advised of the possibility.
12.3 Our total liability for any order shall not exceed the total amount you paid for the relevant products.
12.4 Nothing in these terms limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) your statutory consumer rights; or (d) any other matter that cannot lawfully be excluded.
12.5 Our products are for personal use only. We accept no liability for commercial losses arising from your use of our products.
13. Your Personal Data
We process your personal data in accordance with our Privacy Policy, available at fitbaltics.com. The Privacy Policy describes what data we collect, how we use it, your rights in relation to your data, and how to contact us with any data-related enquiries. By placing an order, you confirm you have read our Privacy Policy.
14. General Terms
14.1 Transfer of contract. We may transfer our rights and obligations to another organisation with prior notice to you. If you are unhappy with the transfer, you may end the contract within seven days and receive a refund for any prepaid, undelivered products.
14.2 Personal rights. You may not transfer your rights under these terms without our written consent.
14.3 Third parties. This contract is between you and us only. No third party may enforce any term of this contract.
14.4 Updates to these terms. We may update these terms at any time. The current version is always posted on our website.
14.5 Severability. If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full force.
14.6 No waiver. Our failure to enforce any right immediately does not mean we have waived that right.
14.7 Governing law and jurisdiction. These terms are governed by the laws of the Republic of Latvia. EU consumer residents retain the benefit of their local mandatory consumer protection laws. Disputes may be brought before the courts of Latvia, without prejudice to your right as an EU consumer to bring proceedings in your own country.
14.8 Online dispute resolution. The European Commission ODR platform is available at https://ec.europa.eu/consumers/odr/ to assist with disputes.
14.9 Statutory rights. Nothing in these terms affects your statutory consumer rights.
